There are many aspects of unit readiness that organizational leaders from the first line leaders up must be involved in; financial readiness being one of those and one that likely merits much more focus than it may be receiving.
In the Human Resources Division of Combined Security Transition Command — Afghanistan, one of our areas of responsibility was accessions and recruitment. This is not a political military paper, so I will not go into the nation building and winning the hearts and minds aspects of the mission.
The key point for this discussion is the financial incentives of their service to the Government of the Islamic Republic of Afghanistan instead of other employment options. The paycheck is typically a prime motivator in choosing employment. And, as one would expect, a significant percentage of the Afghan men who enlisted did so in order to support their families.
Across the hall in the Personnel Actions Directorate they were trying to solve the widespread absent without leave epidemic.
Each section was getting after their particular problem and was focused on developing and emplacing sustainable solutions. But by looking across the division and seeing the challenges each directorate was struggling with, it was easy to see that the root cause was the pay system itself.
In order to bolster a sense of nationality, assignments were strategically managed to ensure units throughout the country were comprised of cross sections of the Afghan ethnic groups. This meant that most Soldiers were stationed far from their homes. They did not have access to banking systems to be able to deposit the pay they received in cash.
There was no direct deposit option and no way to get the money home, except to take it there themselves. It could take days, or even weeks, for them to get home and back.
During this time they were considered AWOL, which negatively affected their next paycheck. That in and of itself, is a different discussion. The problems generated by Soldiers not having adequate means to manage their finances were affecting the ability of the Ministry of Defense, Afghan Security Forces and Coalition Forces to reach required end strength and develop a national Army that would eventually be able to take lead in the protection and guardianship of their own country.
So, why would I subject you to such a boring story of human resource yawn trials and tribulations? Because it is a great example, taken outside the context of our military and our Soldiers that I could use to demonstrate how much of an impact Soldier financial readiness can have on units and the Army as a whole. We are all aware of how the stresses and strains of financial problems can destroy families and personal relationships. Tensions caused by financial trouble can lead to a family breaking up, resulting in the Soldier being distracted from focusing on his or her mission.
And, unfortunately, it sometimes leads to domestic violence in the home. They can lose their security clearances, resulting in them not being able to do the job that they were trained and assigned to perform. They stay on our rolls and prevent us from being able to requisition a replacement.
We have to find somewhere to gainfully employ them which does not require a clearance; which is often easier said than done in some units. Other Soldiers then have to pick up their duties and responsibilities. Our country expects more of us as military professionals and negative behaviors or actions of an individual Soldier reflects badly upon the entire organization.Non-judicial punishment or NJP is any form of punishment that may be applied to individual military personnelwithout a need for a court martial or similar proceedings.
NJP permits commanders to administratively discipline troops without a court-martial. Punishment can range from reprimand to reduction in rank, correctional custody, loss of pay, extra duty or restrictions. The receipt of non-judicial punishment does not constitute a criminal conviction it is equivalent to a civil actionbut is often placed in the service record of the individual.
The process for non-judicial punishment is governed by Part V of the Manual for Courts-Martial and by each service branch's regulations. Non-judicial punishment proceedings are known by different terms among the services. Prior to imposition of NJP, the commander will notify the accused of the commander's intention to impose punishment, the nature of the misconduct alleged, supporting evidence, and a statement of the accused's rights under the UCMJ.
All service members, except those embarked or attached to a vessel currently away from its homeport, have a right to refuse NJP and request a court-martial. If the accused does not accept the NJP, the NJP hearing is terminated and the commander must make the decision of whether to process the service member for court-martial. If the accused accepts NJP, he or she, plus a representative if desired, will attend the hearing conducted by the commander.
The accused may present evidence and witnesses to the commander. The commander must consider any information offered during the hearing, and must be personally convinced that the service member committed misconduct before imposing punishment. Maximum penalties depend on the rank of the accused and that of the officer imposing punishment:. If the officer imposing punishment holds General Court Martial authority, or if the commanding officer is of the grade O-7 or greater.
The punishments listed above may be combined with certain limitations listed in the Manual for Courts-Martial, Part 5, Section 5 d.
For example, extra duties, restriction and forfeiture of pay, and reduction in grade could be imposed. If the member considers the punishment to be unjust or to be disproportionate to the misconduct committed, he or she may appeal the NJP to a higher authority. This is usually the next officer in the chain of command. Upon considering the appeal, the higher authority may set aside the NJP, decrease the severity of the punishment, or may deny the appeal.
They may not increase the severity of the punishment. Personnel are permitted to refuse NJP in favor of a court-martial; this might be done in cases where they do not feel their Commanding Officer will give them a fair hearing.Proof lies on him who asserts, not on him who denies.
The concept is that one is innocent until proven guilty. Regardless of what the law says about reasonable doubt, there is an unwritten presumption within the ranks of the military that if you are charged with sexual assault, then you are guilty. The stakes are your life! Your military counsel works for the same military that charged you.
Consider that as you choose who represents you in your potentially life altering case. To be charged under the articlefor dishonorably failing to pay debt, the accused person should have failed to repay the debt not just due to negligence, but because of the absence of due care. A dishonorable failure to pay is characterized by fraud or deceit, with the accused deliberately, willfully evading the debt or evading it in bad faith.
It is also dishonorable if the debt was based on false promises, all of which are a result of the accused person's overall indifferent attitude towards his or her obligations. Also, the conduct of the accused should have been in a manner such that it causes an obvious and direct damage to the good order of the armed forces, or it should be of such a nature that it damages the reputation of the service. Also, a person cannot be charged of dishonorably failing to pay a debt if there had been an actual dispute between the accused and the party he or she is indebted to, according to the facts or a law that in any way affects the obligation of the accused to pay.
If the court finds beyond reasonable doubt that there is sufficient evidence such as the accused person's past debt history, his failure to make payments, late payments made, failure to pay rent or contact rental agent in spite of receiving a formal notice, then the accused can be convicted of the offense of dishonorably failing to pay the debt.
In the sense, the accused should have a "criminal state of mind" and he or she should be totally indifferent to his or her obligation with regards to the debt. The accused, however, may not be proven guilty if the court fails to obtain facts that suggest that the conduct of the accused was dishonorable with regards to the debt.
Also, it is not an offense if it fails to resolve inconsistencies which suggest the inability of the accused to pay or lack of evasion or deceit on his part. So if the judge or panel finds evidence that suggests otherwise and a lack of "criminal state of mind", such as the accused being in agreement with the creditor, mistakes in the terms of debt or a satisfaction of the debt, the accused may not be guilty of the offense.
It is necessary to note that mere failure to pay the debt back does not make it dishonorable conduct and the accused may be punished for his or her inability to pay. Should the court find evidence, which proves beyond reasonable doubt, that the accused had willfully evaded his or her debt obligations or has denied the existence of debt, or fails to pay the debt in bad faith even after the due date has passed, he or she will be subject to confinement of no more than six months as maximum punishment.
